IDENTIFICATION UNDER CONDITIONS EXCLUDING VISUAL OBSERVATION OF THE IDENTIFIER THE ACCUSED

The article analyzes the tactics of producing a presentation for the identification of living persons in conditions that exclude the visual observation of the identifiable identifier. Recommendations are given to employees of investigative and operational units on carrying out this form of identification of living persons, as well as on ensuring the safety of the victim and the witness of the speakers, in the role of identification. In order to ensure the safety of the victim, his representative, witness, their close relatives, relatives and close persons, the author of the article proposes to add an addition to Article 90 (Securing evidence in the protocols) of the CPC on keeping the identity of the identifying person secret. Also, in order to avoid possible objections from the defense regarding the presence of a lawyer in the room where the identifiable person is or in the room where the identifying person is in practice, the author proposes to amend Article 127 (Procedure for presenting a person for identification) of the Code of Criminal Procedure of the Republic of Uzbekistan.
