SUBJECTIVE SIGNS OF THEFT OF PROPERTY OF OTHER PERSONS BY EXTORTION

In the article, the author describes the objective signs of theft of property of other persons by extortion, some considerations related to the subject and subjective side of this crime. The author also notes that one of the main functions of criminal law is to ensure the inviolability of property rights. It can be said that most crimes will be aimed at generating income, easy acquisition of property or property rights. Such crimes mainly include crimes in the economic sphere, among which the most common are crimes related to theft and fraud. However, among these types of crimes, the crime of extortion differs from both of the most frequently mentioned crimes by the fact that it causes the victim not only material, but also significant moral damage. He also does not inform law enforcement agencies that the victim is threatened with violence against himself or his loved ones, damage to property or destruction of property, or disclosure of information that should be kept secret for the victim during the commission of the crime. This increases the latency of these types of crimes and encourages the person who committed the crime to commit another crime in the future. Article 53 of the Constitution of the Republic of Uzbekistan establishes the creation of property of various forms on the basis of the economy of Uzbekistan aimed at the development of market relations, guarantees the State equal rights of all forms of ownership and enhanced legal protection. In the context of globalization, the sharp development of public relations in our country is the reason for the expansion of forms and types of crimes related to the robbery of other people's property. The author also proposed to supplement criminal liability for extortion with an aggravating feature in accordance with the subject of the crime in the established norm, that is, a sign ‘that the act was committed by a person who had previously committed the crime of robbery’.
