Квалифицирующие признаки незаконного оборота наркотических средств или психотропных веществ

Аннотация

Subjects of research: set of social relations arising in connection with the illegal circulation of drugs and psychotropic substances. Purpose of work: develop proposals for the improvement and construction of aggravating circumstances of the offenses involving responsibility for the illegal circulation of drugs and psychotropic substances, as well as the interrelated circumstances, give suggestions and recommendations on improving the criminal legislation and practice, and explore the causes and conditions of committing the considered crimes and develop recommendations for their prevention. Methods of research: the formal-logical, historical-legal, comparative-legal, concrete-sociological, deduction, induction, analysis, synthesis and other methods of scientific knowledge. The results obtained and their novelty: by results of research variety of offers on formation and addition of new qualifying signs arc formulated and proved, offers on criminalization of socially dangerous acts connected with drugs or psychotropic substances arc forwarded, as well as new legislative mechanism of struggle against investigated crimes the institute of pre-judicial cooperation agreements is presented. Practical value: the results of dissertation research can be used to improve the criminal legislation, the practice of it's application, for further scientific research problems related to illegal circulation of drugs or psychotropic substances. Degree of embed and economic effectivity: the results were presented to the Committee on legislation and judicial-legal matters of the Senate of Oliy Majlis of the Republic of Uzbekistan, to Committee on the legislation and judicial - legal matters of Legislative chamber of Oliy Majlis of the Republic of Uzbekistan, to the National informational-analytical center on drug control under the Cabinet of Ministers of the Republic of Uzbekistan, as well as published by the author in scientific studies. Field of application: scientific rules, conclusions and recommendations can be used in the practice of lawmaking and law enforcing, educational process and research works.
