Аннотация

Subjects of research: legal significant objective signs of murder under aggravated circumstances due to objective side features, qualifications matters, identity of the criminal, their prevention and prophylactic problems. Purpose of work: researching foreign and native Criminal Law norms, specifying responsibility for murder under aggravated circumstances due to objective side features, criminological aspects of the criminal’s identity, to murder, motivations for criminal behavior, as well as activity of law-enforcement bodies due to counteracting and preventing murder. Methods of research: dialectical method of the cognition of social-legal phenomena, general scientific method, formal - logical method, relatively-legal, analytical methods, as well as historical method, allowing to consider the matters of the formation and development of judicial authorities and criminal-procedural legislation. The results obtained and their novelty: includes first time attempt to research the problems of responsibility for murder under aggravated circumstances due to objective side features. Many problems such as provisions of Criminal Code, different doctrinal approaches to the classification of murders under aggravated circumstances due to objective side features, offers and recommendations for improvement of criminal-legal norms have been contributed by the researcher. Practical value: the main provisions and recommendations can be used for development of the theories of Criminal law of the Republic of Uzbekistan, and also they arc useful for judicial and investigation practice, for preparation of explanations of the Supreme Court Plenums acts, as a course book for teaching Criminal Law at Law Institutes and also for professional development courses for law enforcement bodies. Degree of embed and economic effectivity: recommendations worked out on basis of the research results have been established to the Committee on Legislative and Legal matters in the Oliy Majlis, to the Monitoring Centre for Realization Normative-Legal Acts under the Ministry of Justices of the Republic of Uzbekistan, to the Supreme Court. Researcher published scientific articles which have been used in academic process of TSIL. Field of application: Scientific studies, law executive practice, academic process.
