This article examines the formation of the institute of state responsibility within the international legal system and analyzes the role of customary international law in this process. The author explores the significance of customary norms as a source of law, focusing on their development through state practice and opinio juris. Particular attention is given to the 2001 Articles on the Responsibility of States for Internationally Wrongful Acts adopted by the UN International Law Commission, as well as to relevant international court practices. The study concludes that customary international law serves as a fundamental source in determining state responsibility.
