Аннотация

This article provides an in-depth analysis of the two main theoretical approaches to state recognition in international law - constitutive and declarative theories. The study examines the historical development, theoretical foundations and modern practical application of these theories. The article compares the way in which the constitutive theory views recognition as a fundamental condition for the existence of a state and the declarative theory, which considers recognition as a means of declaring the status of an already existing state. The results of the study identify the fundamental differences between these two theories and their application in modern international practice. Keywords: constitutive theory, declarative theory, recognition of states, international law, state sovereignty, Montevideo Convention 39
